If you need a divorce and family law attorney in Wake County, call the Law Office of James Tyler Brooks at 919-238-4085.
When you first contact the Law Office of James Tyler Brooks, you will have the opportunity to schedule a consultation with Mr. Brooks at our office in Cary, NC. We charge only $350 for a one-hour consultation. During that consultation, Mr. Brooks will gather information about your specific situation, explain the divorce and related laws that apply to your circumstances and inform you of your rights under those laws, assess your individual case, and give you roadmap for moving forward while answering any questions you may have about North Carolina divorce law. You will also receive an estimate for our services if you choose to retain our firm.
In general, there are two ways that our firm can help you resolve marital issues (division of marital assets, spousal support, child custody and child support) that arise when you separate from your spouse in Wake County:
- Negotiating and entering into a separation agreement to resolve divorce-related issues; and/or
- Filing a court action to engage a family law judge to resolve these issues
The Law Office of James Tyler Brooks can represent you in one of several different capacities in order to negotiate a separation agreement:
- Negotiating directly with your spouse or your spouse’s legal representation
- Representing you in a meditation using a neutral third party
- Representing you during the collaborative law process
We typically achieve results that are in our clients’ best interests through the negotiation and settlement of their separation and divorce-related issues, as opposed to seeing those issues litigated before the court. Negotiated settlements provide greater certainty of outcomes for all parties involved, and, since we reach these settlements with greater speed than cases that reach divorce court, we are able to contain and reduce costs for our clients. We understand that not all cases can reach an out-of-court settlement, and we are prepared to advocate for you in Wake County court if necessary.
Finally, we offer a very cost-effective option that many of our clients use to settle less complicated marital circumstances. If your divorce does not involve alimony or property division claims, we offer a flat-fee simple divorce. Our firm will represent you in Wake County court during the processing of your simple divorce, also called an uncontested or absolute divorce.
I am always mindful of my client’s legal costs. There are several ways that we can keep costs down. Good advice, however, is the biggest cost-saving tool. By understanding the law and our judges, I am able to give my clients a fairly good estimation of how their particular issues are likely to resolve in court. Armed with that knowledge, clients are able to make rational decisions regarding settlement and often avoid the costs of litigation altogether. Avoiding litigation saves a lot of money. – James Brooks
